Approval Process: Opening used car dealership

Opening used car dealership, the Division of Motorist Services will review and approve all applications and the required documents submitted. Once you have been approved, the dealer will receive a license certificate along with a 4 digit PIN number attached. This 4 digit PIN number is to be used by the dealer only when transacting with the Department, or The Division Of Motorist Services-approved vendors such as a tax collector office or a tag agency. Dealers must keep this information safeguarded in a secure location if available under lock. The dealer should never share the PIN number with anyone other than the Department or a vendor authorized by The Division of Motorist Services. One example of an authorized usage would be a dealer purchasing electronic temp tags from an approved vendor.

If for any reason the pin-number is accidently lost, forgotten or, misplaced, or misused the dealer needs to contact the  Motor Vehicle Field Operations; Regional Office in charge of his dealership for the retrieval of the lost pin-number. The dealer must present a verifiable proof of identity to the Regional Office staff. A dealer that wants to change an existing pin must forward a written request letter to the Division of Motorist Services, Dealer License Section, Tallahassee. The letter must be written on the dealer’s letterhead. Once the request has been received by Department they will verify the signature of the dealer and then grant the request. This is to ensure the confidentiality of the pin-number. The pin-number will not be released by the Division of Motorist without written authorization. The written request should be addressed to:

(4) Requirements for Office Space.

(a) Each licensed motor vehicle dealer shall maintain an office as part of his place of business. The offices of motor vehicle dealers shall conform to the following standards: Opening used car dealership

  1. No office shall be operated from or maintained in any residence.
  2. The office must be in a permanent structure at the licensed location. In the case of an office trailer, the office must be anchored or tied down as required by Rule 15C-1.010, F.A.C.
  3. Each office shall have a minimum of 100 square feet of interior floor space exclusive of any hallways, closets or restrooms and a minimum 7′ ceiling.
  4. The office must be clearly separated from any other business which is being operated in the structure or building which houses the dealership.

(a) Each licensed motor vehicle dealer shall maintain a display space as part of his place of business.

(b) Such display space shall be for the purpose of displaying motor vehicles offered for sale by the motor vehicle dealer and shall conform to the following specifications:Opening used car dealership

  1. The display space of each licensed motor vehicle dealer will be of a sufficient size to store and display all vehicles offered for sale. The display space may be located within a building.
  2. Display spaces shall be under the exclusive control of the motor vehicle dealer and shall not include an area or space set aside for customer, employee or general public parking nor shall it include any public right-of-way.
  3. Display spaces shall be contiguous to the dealership office or shall be situated so as to allow easy access by dealership customers.
  4. Display spaces, whether outside or inside a building, shall have immediate and direct access to a public street or highway or be situated on property, owned or leased by the dealer, to which public access has been granted.
  5. Display spaces shall physically be divided from any other motor vehicle dealer’s display space by a permanent barrier no less than three feet in height and erected in such a manner as to clearly distinguish one dealer’s display space from another dealer’s display space

How to Open Used Car Dealership

  • Proof of identification/DL
  • A true copy of property lease or proof of ownership;
  • Proof of electronic fingerprints (Receipt) for each new officer from a FDLE authorized service provider.
  • Copy of dealer training course certificate;
  • Original surety bond/irrevocable letter of credit.
  • Copy of business and/or fictitious name registration (if fictitious name is applicable) (on-line http://www.sunbiz.org/);
  • Copy of certificate from the Division of Corporations showing current registration of business to conduct business in the State of Florida (on-line http://www.sunbiz.org/);
  • Corporation papers, corporate meeting minutes showing the election of corporate directors, Article of Incorporation if the dealership is a Corporation or Incorporation; Articles of Organization and Operating Agreement if the dealership is a Limited Liability Company; or a Partnership Agreement if the dealership is a Partnership;
  • Independent dealers (VI), Auction dealers (VA), and Wholesale dealers (VW) have the option to submit a copy of: a garage liability insurance certificate which shall include, at a minimum, $25,000 combined single-limit liability coverage including bodily injury and property damage protection and $10,000 personal injury protection; OR
    A general liability insurance policy coupled with a business automobile policy, which shall include, at a minimum, $25,000 combined single-limit liability coverage including bodily injury and property damage protection and $10,000 personal injury.
  • Salvage dealers (SD) are exempt from submitting a garage liability insurance coverage.
  • Franchise dealers (VF), Recreational dealers (RV & RU), and Mobile Home dealers/brokers (DH/BH) selling recreational vehicles must submit a garage liability insurance certificate which shall include, at a minimum, $25,000 combined single-limit liability coverage including bodily injury and property damage protection and $10,000 personal injury protection.
  • Federal Employer’s Identification Number.092, F.S. The term “Employer Identification Number (EIN)” refers to a nine digit number, which are assigned to business entities by the Internal Revenue system https://www.irs.gov/Businesses/Small-Businesses-&-Self-Employed/Apply-for-an-Employer-Identification-Number-%28EIN%29-Online Another name for the Employer Identification Number (EIN) is the Federal Tax Identification Number (FEIN). This number is mandatory for all business that has a bank account, even if it is a single member. Such businesses include: sole proprietors, partnerships, limited liability companies and corporations. It’s also compulsory for employers to have a unique federal employer’s identification number. The federal employer’s identification number, which is normally issued by the Internal Revenue Service, must be boldly written on the license application. On the other hand, self- employed entrepreneurs that have no employee are required to submit an affidavit to that effect along with their application. Form HSMV 86056 can be downloaded from HSMV86056: http://www.flhsmv.gov/dmv/forms/BFO/86056.pdf (the Department’s website). This is the right form that must be filled by anybody applying for a License as a Motor Vehicle, Mobile Home, or Recreational Vehicle Dealer.
  • Sales Tax Number. 15C-7.004, FAC. Those applying for motor vehicle dealer license are required to indicate their sales tax number on their application form. This is in accordance to rule 12A-1.066. The sale tax number can be obtained from the state Department of Revenue Link https://taxapps.state.fl.us/IRegistration/ see Unit 10. Sale tax numbers are usually issued per each location of the dealership. It is the responsibility of the dealer, to collect sales tax on each sale and subsequently remit it to Department of Revenue
  • Two positive print photographs of the proposed licensed place of business. The photographs shall be a minimum of 3” × 4” in size. One photograph shall depict the exterior of the dealership from a distance to clearly show two (2) sides of the building, one side of which shall be the public entrance into the dealership. The second photograph shall show the remaining sides of the building which will house the dealership. At least one of the photographs must reflect the area to be used for display of vehicles/units offered for sale, if display space is required
  • Photos of a permanent sign identifying the dealership at its place of business. Such sign shall clearly identify the dealership and shall use lettering or other graphic representation of sufficient size and color so as to be visible and readable at a distance of 50 yards from the public right-of-way serving the dealership
  • Photos of the hours of operation in a clear manner at or near the main entrance to the dealership office on a placard, sign or by other durable means and shall maintain the posted hours of operation
